Conditions

By "online" sales contract is meant the distance contract, that is, the legal transaction concerning movable goods and/or services entered into between a supplier, Nautica Vega e Levante, and a consumer customer within a distance selling system organized by the supplier who, for this contract, uses exclusively the distance communication technology called "internet." All contracts, therefore, will be concluded directly through the consumer customer's access to the website corresponding to the address www.nauticavegaelevante.it, where, by following the indicated procedures, they will be able to conclude the contract for the purchase of the goods.

Below are the terms and conditions of sale, which will remain in effect until changed by the supplier. Any changes to the terms and conditions of sale will be effective from the moment they are published on the website www.nauticavegaelevante.it, or communicated by email, and will apply to sales made from that moment onwards.

The Customer, by confirming the order electronically, declares to have read and to fully accept the terms of sale and payment indicated in the purchase process and in this contract; he also undertakes to read, print, and keep the terms of sale set out below as provided for in articles 3 and 4 of Legislative Decree no. 185/1999. The entry of false and/or fictitious personal data in the data collection forms required for the completion of the order is expressly prohibited; it is also expressly forbidden to enter data of third parties or to make multiple registrations for a single Consumer.

The Supplier reserves the right to pursue such actions and any other fraudulent action against it and/or to the detriment of other Consumers in a court of law.

To receive an invoice, simply fill in the designated fields in the payment form. To receive a receipt with tax code and VAT indicated separately, you can use the same fields or send us the tax code by email within 24 hours of the order. After this period, it will no longer be possible to request such documentation.

PAYMENTS

The advance bank transfer or advance postal order must be made within 5 days from the order confirmation; after this date, the order will be automatically cancelled. The product will be considered sold only upon verification of payment, so to speed up this verification, please send the payment receipt for the bank transfer or postal order as an email attachment to "vegamareponza@alice.it" or via WhatsApp to the number 3332557708.

SHIPPING

Nautica Vega makes use of close collaboration with several national couriers, choosing which to employ from time to time depending on the type of product. To simplify the evaluation of final costs for the customer right from the start, Nautica Vega applies a single shipping rate policy, which becomes free above a certain amount or for certain products.

The order confirmation email notifies the buyer that the order is being prepared. From that moment, actual delivery may take from 2 to 10 working days, depending on the distance, the carrier, and the type of product. The express courier provides the customer with a tracking number via email within 24/48 hours; for other carriers, we include the option for the recipient to be contacted, where the courier will contact the customer directly to arrange the day and time of collection. No courier delivers to the floor, so the customer is asked to make arrangements in case of bulky and/or heavy packages.

Goods are generally shipped with insurance included. Therefore, upon receipt of the goods, the recipient is required to check that the packages are not damaged, tampered with, or wet, and if necessary, request that the delivery person note collection with reservation. Without this note, it will not be possible to take advantage of the insurance and therefore of any refund or reshipment of the goods. The buyer is still invited to inform Nautica Vega of any delivery delays or any issues encountered. Nautica Vega does not assume responsibility for delays by the courier who takes charge of the package, limiting its responsibility to what is indicated regarding the right of withdrawal. In case of refusal of the package due to carrier delay, provided that Nautica Vega has shipped on time, the shipping costs (both ways) are to be borne by the customer.

The flat rate does not include purchases of large quantities of products that may require the rental of one or more pallets by Nautica Vega. In these circumstances, the price will be communicated to the customer by email or phone, and the customer will have full authority to accept or cancel the order.

Nautica Vega ships only within Italian territory. For deliveries to Livigno, Campione d'Italia, and minor islands, please contact us before completing your order to find out about delivery surcharges.

Unless specific extensions are indicated in the product sheet, all purchased products are covered by the warranty provided by the manufacturer, provided that the product itself has been used correctly, in accordance with its intended use and as specified in the attached technical documentation; furthermore, consumable materials are excluded from the warranty.

RETURN CONDITIONS

Return and warranty replacement shipments are covered by Nautica Vega when the reasons for the return are due to malfunctions or product defects.

For any other reason, shipping costs are borne by the customer (see point 3 below)

In order to take advantage of the warranty, it is essential to provide references that allow us to trace the purchase date, or more simply, to provide the invoice number if purchased with a VAT number.

1. The Customer, pursuant to art. 64 of Legislative Decree no. 206/05, has the right to withdraw from the purchase contract for any reason, except as indicated in point 3 below.

The right of withdrawal can only be exercised by individuals (the final consumer of the good, that is, a Customer who purchases the goods for purposes not related to their professional activity).

2. The right of withdrawal may be exercised by the Customer within 14 (fourteen) working days from the receipt of the product by the Customer, by sending a registered letter with return receipt, anticipated by e-mail to vegamareponza@alice.it, in which it will also be necessary to indicate the bank details required to return the amounts paid.

3. The right of withdrawal is subject to the following mandatory conditions:

• the right applies to the purchased product in its entirety; it is not possible to exercise withdrawal only on part of the purchased product (e.g.: accessories, attached software, etc...);

• the purchased item must be intact and returned in its original packaging, complete in all its parts including packaging and any documentation and accessories: manuals, cables, etc...); to limit damage to the original packaging, we recommend, when possible, placing it in a second box;

• the item subject to the right of withdrawal must be returned in a normal state of preservation, as it has been kept and possibly used with normal care: therefore, used products showing signs of damage or dirt, and which can therefore no longer be considered intact, will not be accepted;

• The return must be carried out by the Customer, by shipping the products subject to withdrawal, using a courier of their choice. The products must be shipped no later than 14 working days from the date of delivery.

Exclusions: certain specific products are excluded from the right of withdrawal due to their nature, which would not allow us to resell them. Products that are not in the catalog and expressly ordered from the supplier at the customer's request, products customized for the customer (modified, embroidered, made to measure), products sold by the meter and therefore cut to the size requested by the customer (tubes, ropes, chains, etc.), and products registered, licensed, or dated at the time of sale (e.g. Epirb, life rafts, etc.) are excluded from the right of withdrawal.

Partial refund: if the reasons for withdrawal are not due to a malfunctioning or defective product, Nautica Vega reserves the right to refund an amount less than 100% of the paid cost. The exact amount will be communicated at the time of the withdrawal request.

Once the integrity of the returned product has been verified, Nautica Vega will refund the Customer the full amount paid for the products covered by the Purchase Agreement subject to withdrawal, within and no later than 30 days from the return of the products themselves. The refund will concern only the price of the returned products, excluding order management costs (packaging, shipping, cash on delivery, etc.). Since Nautica Vega applies flat-rate shipping and cash on delivery costs depending on the purchase, it is possible that in the event of withdrawal the customer will be charged the difference between the flat-rate costs applied to the order and the actual costs incurred by Nautica Vega. The refund will be made by reversing or crediting the amount charged to the Consumer Customer's Credit Card indicated by the Customer or by Bank Transfer, in accordance with the relevant instructions and bank details provided by the same Customer.

4. Without prejudice to any restoration costs for damages found to the original packaging (which for some products may reach up to 30% of the product's value, as it will have to be resold as "refurbished"), Nautica Vega will refund the Customer the amount already paid, as soon as possible and in any case within 30 days from the date of receipt of the withdrawal notice, after receiving the goods subject to withdrawal, through a procedure of reversing the amount charged to the Credit Card or by Bank Transfer. In the latter case, it is the customer's responsibility to promptly provide the bank details on which to obtain the refund (IBAN code of the invoice holder).

5. The right of withdrawal is completely forfeited, due to the lack of the essential condition of integrity of the product (packaging and/or its contents), in cases where Nautica Vega ascertains:

• the absence of the external packaging, broken blister and/or the original internal packaging;

• the absence of integral elements of the product (accessories, cables, manuals, parts, ...) or anomalies in the product itself;

• product damage;

• a state of dirtiness of the product due to its use, which has compromised its integrity. The costs and risks of transport for the return are entirely borne by the Customer. The return of products that are not intact, deteriorated or lacking original accessories and equipment will not be accepted by Nautica Vega and will be returned to the sender with additional transport costs.
